These Website Terms and Conditions (“Terms”) govern your use of the Spare Nest Storage LLC website and its online rental and payment services. By using this website, creating an account, submitting information, making a payment, or completing an online rental, you agree to these Terms.

1. About Spare Nest Storage

Spare Nest Storage LLC (“Spare Nest,” “we,” “us,” or “our”) operates a self-service storage facility located at:

2. Website Use

You may use this website only for lawful purposes. You agree not to:

  • Provide false, incomplete, or misleading information;
  • Attempt to gain unauthorized access to another person’s account or access credentials;
  • Interfere with the website or its security features;
  • Introduce malicious software or harmful code;
  • Use the website to violate any law or the rights of another person; or
  • Copy or misuse website content, branding, photographs, or materials.

You must be at least 18 years old and legally able to enter into a contract to rent a storage unit.

3. Online Rentals

Storage-unit availability, dimensions, prices, promotions, and features displayed on the website are subject to change. Unit dimensions are approximate. Submitting a reservation or rental request does not guarantee availability until the rental process has been completed and accepted.

Every storage rental is governed by a separate Rental Agreement. If these Website Terms conflict with the Rental Agreement concerning a storage tenancy, the Rental Agreement controls.

Completing an online rental does not permit the storage of prohibited property or authorize any use that violates the Rental Agreement, facility rules, or applicable law.

4. Payments and Recurring Charges

Rent is due monthly on the anniversary date of the rental start date. When you authorize automatic payments, you authorize Spare Nest and its payment processor to charge your selected payment method for rent and other authorized amounts in accordance with the Rental Agreement.

A payment is not considered completed until it has been successfully processed. Declined or returned payments may result in fees, restricted facility access, overlocking of the unit, or other remedies permitted by the Rental Agreement and Minnesota law.

Applicable prices, recurring charges, fees, and payment terms will be disclosed during the rental process or in the Rental Agreement. You are responsible for keeping your payment and contact information current.

5. Insurance or Tenant Protection

Renters are required to maintain coverage for their stored property. Renters may provide proof of qualifying insurance and are not required to purchase coverage through Spare Nest Storage.

If acceptable proof of insurance is not received within 15 days of enrollment, coverage offered through or arranged by Spare Nest may be added at the then-current rate, as described in the Rental Agreement. Any insurance or tenant-protection program may be subject to separate terms, conditions, limitations, and exclusions.

6. Electronic Communications and Signatures

By using our online services, you consent to receiving agreements, disclosures, notices, receipts, and other communications electronically when permitted by law. Electronic signatures and records have the same effect as paper documents and handwritten signatures to the extent permitted by applicable law.

You are responsible for providing and maintaining a valid email address and telephone number. Consent to receive promotional messages is not required as a condition of renting a unit.

7. Facility Access

Online account access and payment services may be available 24 hours a day. Physical access to the facility is limited to established facility access hours, currently 6:00 a.m. to 10:00 p.m., 365 days a year.

Website services, gates, keypads, payment systems, and other technology may occasionally be unavailable due to maintenance, weather, equipment malfunction, internet or power failure, emergencies, or circumstances beyond our reasonable control.

8. Website Information

We make reasonable efforts to provide accurate information, but we do not guarantee that all website content will always be complete, current, or error-free. Photographs and illustrations may be representative. Please contact us if you need confirmation of a unit’s measurements or features.

Our website may use or link to third-party services, including storage-management software, payment processors, insurance or tenant-protection providers, mapping services, and other service providers. Their services are governed by their own terms and privacy practices.

Spare Nest is not responsible for the content, availability, or independent practices of third-party websites or services.

10. Intellectual Property

The Spare Nest Storage name, owl logo, website design, text, images, slogans, and other original materials are owned by or licensed to Spare Nest Storage LLC and may not be copied, modified, distributed, or used without written permission.

11. Disclaimer and Limitation of Liability

The website and online services are provided on an “as available” basis. To the extent permitted by law, Spare Nest does not guarantee uninterrupted or error-free website operation.

To the extent permitted by law, Spare Nest is not liable for indirect, incidental, special, or consequential damages arising solely from the use of or inability to use the website. Nothing in these Terms excludes liability that cannot lawfully be limited or disclaimed.

12. Privacy

Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this website with a new effective date. Changes will not retroactively alter an existing Rental Agreement unless permitted by that agreement and applicable law.

14. Governing Law

These Terms are governed by the laws of the State of Minnesota. Any dispute relating to these Terms will be handled in a court with proper jurisdiction, subject to any controlling provision in the Rental Agreement.

15. Severability

If any portion of these Terms is found unenforceable, the remaining provisions will continue in effect.
